Klife Terms of Use

These Terms of Use ("Terms") govern your access to and use of the KLife mobile application (the "App", the "Service"), provided by Hariss International Ltd ("the Company", "We", "Us", "Our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 16 years old to use the App, and you must meet any higher minimum age set by the law of your country. If you are below the age of majority where you live, you may use the App only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

KLife is a fitness-tracking application. It allows you to record runs, walks and rides using the Global Positioning System (GPS) and your device's motion sensor, to view and share your activity history, and to save and re-run routes.

IMPORTANT - READ CAREFULLY.

The App is intended to help you track physical activity and is not a medical device. The App does not provide medical advice, and any information displayed (including step count, calorie estimates, distance, or pace) is for general informational purposes only and should not be relied upon as accurate for medical, diagnostic, or health-management decisions.

The guided workouts, training plans and meal plans available in the App are general information, not personalised advice, and are not prepared for your individual circumstances or dietary needs.

Before beginning any physical activity program, including participation in a running event, or making any change to your diet, you should consult a physician or qualified healthcare provider, particularly if you have any pre-existing medical condition. You assume all risks associated with physical activity undertaken in connection with your use of the App, including risks of injury. The Company is not responsible for any injury, illness, or health consequence arising from your participation in any activity tracked through the App or any event you join.

The App relies on your device's GPS and network signal to estimate location, distance, and route. GPS accuracy can be affected by signal strength, device hardware, weather, and terrain, and may be reduced or interrupted, including during background tracking or periods without connectivity. Distance, pace, and leaderboard standings displayed by the App are estimates and are not official or verified results. The App is not intended for use in emergencies, and you should not rely on it for navigation or safety-critical purposes.

During a live event, your self-entered name, category, and activity data may be visible to other participants and viewers through the event leaderboard. Leaderboard standings reflect activity recorded through the App by users who chose to participate and are not official results of any third-party event organizer, timing system, or registration provider. The Company reserves the right to remove any entry it reasonably believes reflects inaccurate, fraudulent, or manipulated data (for example, location data reflecting an impossible speed or distance).

Where the App lets you register for an organised event, that registration is for a real-world event run by its organiser. Any entry fee is arranged and paid outside the App, and no digital content or App feature is unlocked by paying it. The organiser's own terms, entry requirements, refund policy and decisions govern your participation, and the Company is not responsible for the running of an event it does not organise.

With your permission, the App uses your device's location services, including in the background, so that a session keeps recording with the screen off, and your device's motion sensor, to count steps. It may also ask to send you notifications, and to reach your photo library if you choose a profile or group picture.

You may withdraw any of these permissions at any time through your device settings, though doing so may limit App functionality. Data collected under these permissions is used solely to provide App features and is handled as described in our Privacy Policy.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.

The App uses third-party services to operate, including Apple and Google, mapping and places providers, hosting infrastructure, a messaging provider, push notification services, and a product analytics and error-monitoring provider. These providers have their own terms and privacy practices, which are not controlled by the Company but which are expected to be in tandem with internationally recognised general principles of data protection.

The App, including its design, branding, and underlying software, is owned by the Company or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the Company's or any sponsor's trademarks or branding without prior written permission.

You may stop using the App and delete your account at any time, from your profile's account settings. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the Service.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GPS, STEP COUNTS, OR ANY FIGURE ESTIMATED FROM THEM WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP OR PARTICIPATION IN ANY EVENT, INCLUDING ANY PERSONAL INJURY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

You agree to indemnify and hold harmless the Company, its affiliates, and sponsors from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your participation in any event.

These Terms are governed by the laws of Uganda including any amendments thereto without regard to conflict of law principles. Any disputes arising from these Terms or use of the App shall be subjected to private mediation, failure of which the same shall be submitted to arbitration in accordance with Uganda's Arbitration and Conciliation Act Cap 5.

If you downloaded the App from the Apple App Store, the following additional terms apply and take precedence over any conflicting term above with respect to your use of the App on Apple devices:

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.
